Fisher Legal, PLLC

Law, land, legacy.

Legal counsel for North Carolina landowners, from an attorney who builds, conserves, and farms land himself.

Talk about your land See practice areas

For more than twenty years, I have built land businesses, conserved land, and farmed it. I have been the landowner, the buyer, the investor, and the land trust.

I bring that experience to your matter: I read the documents closely, and I also ask what will actually work for your land, your family, and your business. You work directly with me, from the first call to the final agreement.

Practice Areas

Legal help for the people who own, work, and care for North Carolina land.

Conservation Easements

A conservation easement can keep land as it is for generations while the family keeps ownership.

I do not give tax advice. On the tax side, I work closely with each client's CPA or tax advisor.

  • Decide whether an easement fits your goals and your family
  • Meet the legal requirements for the federal deduction, working with your CPA or tax advisor
  • Pursue state funding and tax credits, including the N.C. Land and Water Fund and the N.C. conservation tax credit
  • Negotiate terms that protect the land and still allow it to be farmed and managed

Working with Land Trusts

Land trusts have their own boards, budgets, standards, and timelines. I know them from the inside: I was a project director with The Nature Conservancy, executive director of the Tar River Land Conservancy from 2001 to 2005, and founder of Unique Places to Save.

  • Choose a land trust that fits the property and the family
  • Navigate project review, board approval, and baseline documentation
  • Negotiate reserved rights and stewardship contributions
  • Work through monitoring, amendments, and disagreements after recording

Utilities, Pipelines & Condemnation

When a pipeline, power line, wastewater line, or road is routed across your land, the first offer is rarely the last word. The route, easement width, construction methods, restoration, and compensation are all open to negotiation.

  • Press for routes that do less harm, starting in the route-selection study
  • Negotiate easement terms, construction conditions, and compensation
  • Secure restoration standards for streams, forests, and farmland
  • Coordinate eminent domain litigation when the utility or agency moves to condemn, working with trial counsel where needed

Environmental Matters

Wetlands, streams, and buffers shape what an owner can build, harvest, restore, or sell.

  • Understand federal and state wetland and stream rules before work begins
  • Work with the U.S. Army Corps of Engineers and N.C. DEQ on permits
  • Plan restoration and negotiate mitigation bank and credit agreements

Farm, Agritourism & Land Use

North Carolina protects working farms from much of county zoning, but only operations that qualify and stay qualified. I farm and host events on farmland myself, so I deal with these questions firsthand.

Aerial view of farm rows and buildings
  • Establish and document bona fide farm status
  • Use the farm exemptions where they apply
  • Qualify for and keep present-use value taxation
  • Structure agritourism, event, and farm-stay operations
  • Find the lawful path through zoning, septic, and land-disturbance rules

Family Land & Legacy

Land held for generations can be lost in one, to a forced partition, a tax bill, or heirs who cannot agree.

I do not give tax advice. I work alongside your CPA, tax advisors, and estate planning counsel.

  • Plan how land will pass to the next generation
  • Hold family land in LLCs with clear rules for decisions, buyouts, and use
  • Resolve heirs' property and clouded title
  • Pair succession planning with conservation where it fits

Land Matters

  • Deeds, family transfers, and title clean-up
  • Access easements and road maintenance agreements
  • Boundary and right-of-way questions
  • Timber, hunting, and recreational leases
  • Operating agreements and investor structures for land acquisitions

Land & Business Disputes

Most disputes over easements, access, boundaries, and contracts are better settled than fought.

I take on litigation case by case. I also coordinate litigation for clients, including eminent domain cases, and work collaboratively with other litigators as part of the client's team. Fisher Legal is growing, and I plan to add an experienced litigator.

  • Understand the documents, the facts, and your real options
  • Negotiate with neighbors, partners, land trusts, and agencies
  • Assess whether a dispute is worth litigating, and what it will cost

Our Approach

Understand the land. Read the documents. Tell the truth.

Strategy first.I ask what outcome would actually work, then build the plan to get there.
A landowner's view.I own, farm, and manage land, and I face the same questions my clients do.
Plain language. You should understand every document you sign, including its risks and costs.
The right team. When a matter needs a surveyor, engineer, appraiser, CPA, or another lawyer, I will say so and help bring them in.
Independent counsel.Fisher Legal is separate from Arcadian Land & Water, The Honeysuckle, and my other ventures. I do not provide legal services through them, and I check conflicts before taking any matter that touches them.

About Jeff

Jeff Fisher is a North Carolina attorney, land entrepreneur, and farmer.

He began his career on the land trust side, as a project director with The Nature Conservancy and executive director of the Tar River Land Conservancy from 2001 to 2005. He is a principal at Arcadian Land & Water, a land investment and advisory firm, and founded Unique Places to Save, a nonprofit land conservancy.

Jeff and his wife, Svetlana, run The Honeysuckle, a working farm and tea house in Orange County. Farming keeps him close to the zoning, septic, easement, and tax questions his clients bring him.

He practiced law with Forrest Firm and Tuggle Duggins before opening Fisher Legal. He holds a J.D. from the UNC School of Law, a Master of Environmental Management from Duke University, and a B.A. in Political Science from N.C. State University.

He believes land trusts, developers, farmers, and landowners all shape the land, and that good outcomes come from finding common ground among them.

Admitted: North Carolina State Bar
